GENERAL TERMS AND CONDITIONS​

3D PARATI BENELUX BV

1. Unless otherwise stated and clearly indicated, each order implies acceptance of our terms and conditions by the customer and the renunciation of their own terms and conditions of purchase and sale.

2. The agreed delivery period applies only to goods available from stock. In all cases, the delivery period is merely an indication and is not binding. The buyer cannot assert any right to compensation, nor can they demand termination or cancellation of the agreement if the deadlines are not met.


3. The seller is entitled to make partial deliveries.


4. Goods always travel at the buyer's expense and risk, regardless of who carries them and on whose behalf. Additional costs for express shipping are also always borne by the buyer. Upon collection, preferential treatment entails an administration fee. Delivery is subject to the current rate.


5. Unless otherwise agreed in the contract, our invoices are payable upon placing the order and/or before delivery of the goods.


6.  Agreements concluded by our representatives are only valid after our approval. Our representatives are not authorized to collect our invoices or issue a valid receipt.


7.  To be valid, any complaint must be submitted within 8 days of delivery by registered letter, otherwise it will be considered null and void.


8.  Sending the invoice constitutes a formal notice of default for payment in good and valid form. In the event of non-payment, the outstanding balance will become immediately due and payable, automatically and without further notice of default, and will accrue interest at a rate of 3% per month. The seller will also be entitled to claim an additional amount equal to 10% of the outstanding balance, with a minimum of €90, as a lump sum compensation, expressly agreed upon between the parties.


9. 3D PARATI BENELUX BV remains the owner of the goods until the date of full payment of the principal and/or interest and/or fixed compensation. The buyer hereby instructs the seller to pay all amounts owed to the seller by third parties. The buyer releases the seller from any formal notification and shall bear all related costs. The buyer also grants the seller the right to collect the delivered materials at any time, wherever they may be located. To the extent necessary, the buyer authorizes the seller to enter the premises occupied by the buyer.


10. The fact that the buyer may not have received our general terms and conditions of sale in his native language does not exempt him from their application.


11. All terms and conditions shall be construed in favor of 3D PARATI BENELUX BV.


12.  The seller is understood to be 3D PARATI BENELUX BV, the buyer is understood to be the customer.


13. Any dispute that may arise between the parties may be settled exclusively by the courts of Belgium, Antwerp district, for both national and international transactions.
